### Participation and bids Participation is limited to people domiciled in Switzerland or France. Participants must be adults, use their own account, accept the applicable terms and collection arrangement, and receive Studio approval before bidding. An account alone is not approval. This adult-participation rule does not imply an automatic age or identity verification beyond checks actually demonstrated.
Bidding is ascending in Swiss francs: opening bid CHF1’500, minimum increment CHF100 above the highest accepted bid, no reserve. A larger increase is permitted; equal or insufficient bids are rejected. A submitted request is not an accepted bid: the system must confirm acceptance. Placing a bid does not charge a card. Bidder identities are not publicly displayed.
The duration is exactly250hours, or900,000seconds, calculated in UTC and displayed in Geneva time/Europe/Zurich. Opening is15October2026 at20:00 CEST and closing is26October2026 at05:00 CET, Geneva time/Europe/Zurich (18:00 UTC and04:00 UTC respectively). Closing is fixed, without automatic extension; the countdown is indicative. Only valid bids accepted before closing count. The highest such bid determines the winner, subject to applicable mandatory rights and remedies.
### Price, payment and no automatic reassignment The awarded price includes the work, frame, certificate and complimentary Geneva collection. No compulsory charge not disclosed before a binding bid is added. No tax-deductible donation or charitable tax benefit is promised to the buyer.
The winner receives a private invitation stating the amount and exact deadline. Payment is due within48hours of the verified invitation. Opening a link, an attempt, retry or authentication does not extend this deadline. WooCommerce and Stripe support payment using the methods actually available.
Ambiguous, late or missing financial outcomes are reviewed and reconciled manually. They do not automatically create a further charge, refund or award. Nonpayment does not automatically reassign the work; the Studio handles the case individually under applicable rights.
### Geneva collection — no international delivery offered The work will be available for complimentary Geneva collection by appointment within five working days after confirmation of full payment. This is availability for collection, not a guaranteed transport date.
Before the first binding bid, the participant confirms personal collection or collection by an expressly authorised person. The Studio agrees the appointment and proportionate information needed for correct handover. No international transport service is included or promised. The Studio imposes no later transport, insurance or customs-clearance charge.
A buyer planning subsequent export must review the formalities and costs of that plan before bidding, with the Studio and the competent customs service where needed. The Studio supplies accurate agreed sale/artwork documents. No exemption, absence of import VAT or absence of duty is guaranteed. Collection does not waive mandatory buyer protections.
The Studio retains the contractually agreed responsibility for the work until physical handover to the buyer or authorised representative, without reducing mandatory protections.
### Consumer domiciled in France — withdrawal Where entitled to the applicable distance-contract withdrawal right, a consumer may withdraw without giving a reason within fourteen days after physical possession by the consumer or their designated third party other than the carrier. Geneva collection alone does not exclude that right. The work being unique or already completed is not represented as a made-to-order exception.
A clear statement sent before expiry to Mauro Carraro at the postal address above or info@maurocarraro.com is sufficient; the form below is optional. Electronic notices are acknowledged on a durable medium. The work must be returned or sent back without undue delay and within fourteen days of the notice, using return arrangements that do not reduce those rights.
Reimbursement includes payments received and any applicable standard delivery charge, within fourteen days of notice, using the original payment method unless expressly agreed otherwise without fees. The Studio may withhold reimbursement until receipt of the work or evidence of its dispatch, whichever is earlier, unless it offers to collect the work. No arbitrary administrative or payment fee is deducted.
For this sale, no direct return costs under the French withdrawal right are imposed on the buyer. The Studio bears those costs and agrees return arrangements with the buyer; these arrangements do not restrict the statutory withdrawal-notification period. Any liability for diminished value remains limited by applicable mandatory law. No administrative or payment-processing fee is imposed for exercising withdrawal.
Optional form: To Mauro Carraro,11 rue Joseph-Pasquier,1203Genève,Switzerland, info@maurocarraro.com. I notify withdrawal from my contract for A Letter to Time. Order/award date: consumer to complete. Receipt date: consumer to complete. Consumer name and address: consumer to complete. Date: consumer to complete. Signature only for paper notice. This form does not require public disclosure of these details.
For a Swiss buyer, no additional voluntary change-of-mind return is offered; any applicable mandatory rights remain reserved.
### Errors, defects, interruption and applicable law Report a suspected bidding error, incident, incorrect description, defect or damage promptly to info@maurocarraro.com. The Studio reviews the facts and applicable remedies; replacement of a unique original cannot be promised. No clause excludes legal guarantees or mandatory rights, including applicable French consumer conformity protections. Requests for photographic assistance do not improperly condition those rights.
A material verified technical anomaly may require suspending further actions during review while preserving accepted bids, orders, payments and journals. It does not trigger automatic refund, deletion or reassignment. Swiss law is proposed subject to applicable mandatory rules; no exclusive forum contrary to mandatory consumer protection is imposed.
### Charitable purpose and transparency Mauro Carraro is the sole seller and personally assumes the charitable undertaking. The Fonds Pierre Amstutz is the intended beneficiary, subject to its acceptance. No Fund agreement, partnership or mandate from any organisation is represented as already obtained. Virginie Rousseaux’s written support in principle and the introduction facilitated by Aurélie Streit do not replace the Fund’s acceptance.
The amount to be allocated is the entire auction price actually received, reduced only by actual refunds or financial reversals of that price. No production, framing, organisation, payment-processing, transfer, tax or artist-remuneration costs are deducted: Mauro bears these costs. The buyer receives a verifiable reconciliation and proof of transfer. No tax deductibility is promised to the buyer.
If the Fund refuses, or its acceptance and verified transfer arrangements are unavailable within60calendar days after receipt of full payment, Mauro will allocate the same amount to the Association des Amis de la Fondation Battenberg, Rue du Midi55,2500Biel/Bienne6, through its official donation channel. Transfer to the selected beneficiary will take place within90calendar days after receipt of full payment. Mauro keeps the amount available until transfer; the platform does not provide an escrow service.
The alternative destination supports vocational training and professional inclusion for people with special needs; no exclusive allocation to watchmaking training is promised. The Association is not represented as having accepted this specific initiative. Use of this predetermined alternative does not by itself terminate the sale. Mauro remains personally responsible for the charitable undertaking; applicable remedies for non-performance and all mandatory buyer rights remain preserved. Any legally required refund after transfer remains Mauro’s responsibility and creates no unagreed repayment obligation for an organisation.
### Data and communications Data is used for accounts, admission, consent, bids, award, payment, collection, support and applicable obligations as described in the separate privacy notice. Necessary auction messages do not constitute marketing consent. No participant list or participant personal data is intended for the Fund.
### French consumer statutory guarantees Where French consumer rules apply, Mauro Carraro is responsible for conformity for two years after delivery; defects appearing during that period are presumed pre-existing for this new work. Remedies are free, within thirty days and without major inconvenience. Repair or replacement may be impossible for this unique original; statutory price-reduction and termination remedies remain available. Hidden-defect claims may be brought within two years of discovery, seeking return against reimbursement or a price reduction. Contact: info@maurocarraro.com.
Further information on French statutory guarantees
A repair under the conformity guarantee extends the initial guarantee by six months. If the buyer requests repair but the seller instead imposes replacement, a new two-year conformity period starts on replacement. Price reduction or termination may be available where the seller refuses repair or replacement, the remedy takes more than thirty days, causes major inconvenience including unreimbursed collection/removal or installation costs, or fails to resolve the nonconformity. A sufficiently serious defect permits an immediate price reduction or termination without first requesting repair or replacement. A minor nonconformity does not entitle the buyer to termination. Time during which the work is unavailable for repair or replacement suspends the remaining guarantee period until the restored work is delivered.
These rights arise under French Consumer Code articles L217-1 to L217-32 where applicable. Bad-faith obstruction of the conformity guarantee may incur the civil fine prescribed by L241-5, up to EUR300,000 or10% of average annual turnover. The framed original contains no digital content or digital service. Its uniqueness does not extinguish applicable statutory remedies where repair or replacement is impossible.
